Bankruptcy Options in California

  • Chapter 7, called “straight” bankruptcy or liquidation bankruptcy

The most common form of bankruptcy is Chapter 7, in which your nonexempt assets are liquidated to pay back your creditors. This type of bankruptcy allows you to keep your exempt property, such as your home, furniture, vehicles, certain benefits, and pensions. Your unsecured debt – such as credit card debt, payday loans, medical expenses, and personal loans – are discharged through the process, leaving you with a clean slate.

Those individuals who do not qualify for a Chapter 7 have the option of a Chapter 13 bankruptcy, which involves a three- to five-year repayment plan. Once the plan has concluded, any remaining debt is discharged.
