Do I Qualify for a Green Card?

You may be eligible for a green card depending on your situation. There are many paths toward gaining lawful permanent residency. You can apply for a green card from within the U.S. or from your home country through U.S. consular processing!

You may be qualified to obtain a green card if you:

  • Are sponsored by a family member who is a U.S. citizen or lawful permanent resident

  • Marry a U.S. citizen

  • Are sponsored by a U.S. employer as an immigrant worker

  • Obtain refugee or asylee status

  • Obtain immigration status as a victim of human trafficking or a crime

  • Invest in a U.S. business

Filing an Application for a Green Card

If you are applying for a green card within the U.S., you or your sponsor will need to submit a specific petition and meet all eligibility requirements. Depending on the process through which you are applying, you will need to take specific steps to ensure your success. For instance, labor certification is required for your employer to be able to sponsor you.

If you are outside the U.S., you must apply for a visa through the U.S. Department of State consulate in your country. This route also includes filing a petition on your behalf, such as through family or employment.

If applicable, you may need to pay a fee for filing and you must provide evidence and supporting documentation per the application.

What Happens After You File?

When USCIS receives your application, you will receive a confirmation in the mail. You will also be notified if you are required to complete a biometric services appointment and/or a notice to appear for an interview. Not all applicants will be required to complete these. If you are not required to do anything further, you will receive a notice of decision!
